The petitioner is accused in connection with Kacchawa P.S. Case No. 42 of 2014 registered under Sections 341, 323, 324, 326 and 302/34 of the Indian Penal Code. The accusation is that 13 persons named in the F.I.R. including the petitioner started to cause assault to the husband of the informant, while informant made request to set free to her husband. At that time, Punam Devi put the nail at the leg of husband of informant whereas Kamla Devi caused injury at the testicle of her husband.
Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner to cause injury to the husband of the informant. It is further submitted that
Patna High Court Cr.Misc. No.1931 of 2017 (2) dt.20-01-2017 petitioner has no criminal antecedent and is in custody since 17.05.2016. It is further submitted that co-accused, Shiv Rajak @ Langru Rajwar and Ajay Rajwar, have already been granted privilege of bail by this Court vide order dated 21.09.2015 passed in Criminal Misc. No. 43570 of 2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Kacchawa P.S. Case No. 42 of 2014. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
