JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kotwali P.S. Case No. 179 of 2016 instituted for the offence under Sections 411, 413, 414 and 401 of the Indian Penal Code. It is alleged that on secret information, the police arrested two persons namely, Kumar Sanu @ Chhotu and Md. Dilshad along with stolen motorcycle. They disclosed the names of several accused persons including the petitioner in their confessional statement as mentioned in the written report. The name of the petitioner appears at Sl. No. 12 in the accused column of the First Information Report, named as Md. Sonu, son of Md. Saukat.

It has been submitted that the other co-accused person

Patna High Court Cr.Misc. No.9615 of 2017 (2) dt.07-03-2017 2/2 has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.11.2016 passed in Cr. Misc. 47690 of 2016.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Kotwali P.S. Case No. 179 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
