The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 307, 302, 323, 353, 333, 324, 225/34 of the Indian Penal Code, Section 27 of the Arms Act and 18/20 of UAPA Act.

The prosecution story, in brief, is that the F.I.R. named accused persons and 100-125 unknown opened fire on the police personnel threw bricks and got released Baunu Sada, after killing one SAP personnel and causing injury to the informant and other police personnel.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.07.2016. The charge sheet has

Patna High Court Cr.Misc. No.44338 of 2016 (2) dt.18-10-2016 2/2 been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner. The other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R. along with other 33 named persons.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, J.M.1st Class, Begusarai, in connection with Neemachandpura P.S. Case No. 71 of 2015.
