JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending their arrest in a case instituted under Sections 302 and 201/34 of the Indian Penal Code.

The prosecution story, in brief, is that the informant was a Dafadar of Sonepur Police Station and on the relevant date he was moving in the area in the morning just in order to know the situation of the surrounding and in that course when the informant arrived near Railway Bhoari situated at Chiraiya Bazar, Sonepur he saw that a group of persons had assembled near the Bhoari and when the informant went there a dead body of an

No.52217 of 2014 (5) dt.02-07-2015 2/3 young person having cut mark on the neck with blood, injury on the right side below the chest, and abrasion near the right arm pit was laying. The due information was given to the police station by the informant and tried to identify the deceased but nobody identified. It is also alleged that near the dead body of the deceased one red coloured shirt stained with blood, cream colored jeans shoes of Rebook with grey colored socks, leather belt, a locket, Gamcha stained with blood were found with the deceased. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is not named in the FIR. The name of the petitioner has come in the present case in course of investigation on the basis of confessional statement of co accused. On behalf of the State, It has been admitted that the petitioner is not named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anchal Dwivedi, Judicial Magistrate, 1st Class, Saran at Chapra, in connection with Sonepur P.S.Case No.96 of 2013 , subject to the
