Petitioner seeks bail in Araria (Bairgachhi) P.S. Case No.640 of 2018, registered under Sections 30(a), 36 and 38 of the Bihar Prohibition and Excise Act, 2016.

The Scorpio of the petitioner bearing Registration No.BR11Q 1763 was intercepted and on search it was found that the petitioner was carrying 800 bottles of cough syrup and 115 cartons of Nitravet-10 tablets.

Learned counsel for the petitioner submits that the petitioner was driver of the vehicle. Muzahid hired the vehicle and at the instance of Muzahid he was carrying the medicine. The owner of the vehicle has already been enlarged on bail. Petitioner is the son of the owner of the vehicle. Considering the nature of allegations made against the

No.73552 of 2018(2) dt.11-12-2018 2/2 petitioner and the fact that the petitioner is in jail since 24.09.2018, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Araria (Bairgachhi) P.S. Case No.640 of 2018 (Special Case No.1139 of 2018).
