JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-08-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a), 30(b) and 30(c) of the Bihar Prohibition and Excise Act. 70 litres of country made liquor and other utensils used for preparing country made liquor have been recovered. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner. The chowkidar has disclosed the name of the petitioner. It is also submitted that the petitioner has got no criminal antecedent as

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that petitioner is the member of the syndicate involved in manufacturing illicit country made liquor.

Taking into consideration the fact that the petitioner is the member of the syndicate involved in manufacturing illicit country made liquor, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected in connection with C2A Case No.272/2021, pending in the court of learned Additional District & Sessions Judge-cum-Special Judge Excise-2nd, Vaishali at Hajipur.
