JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 This application has been filed for cancellation of anticipatory bail granted to opposite party Nos. 2 to 8 by learned Additional Sessions Judge-I-cum-Special Judge, SC/ST Act, Katihar by order dated 13.9.2018 in ABP No. 79 of 2018 in connection with Barari P. S. Case No. 328 of 2018. The ground for cancellation of bail is that under SC/ST Act anticipatory bail ought not to have been granted by learned Sessions Judge but learned Sessions Judge considering

Patna High Court CR. MISC. No.74417 of 2018(2) dt.24-02-2020 2/2 the fact that there is land dispute between the parties has granted bail to the opposite party Nos. 2 to 8.

Heard learned APP also.

Having heard both sides and from perusal of the record it appears that the order has been passed in the year 2018 and there is no case of misuse of privilege of bail or tampering with the evidence. However, I find that there is no allegation of assault and abuse in public view, as such I am not inclined to interfere with the order passed by learned Sessions Judge. Accordingly, this application is dismissed.
