The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 323 and 504/34 of the Indian Penal Code.
Allegation against the petitioner is that he induced the informant and established physical relation with her. Today the case is fixed for appearance of the parties. The informant is present and submits that she is still ready for marriage with the petitioner whereas petitioner is not present.
Learned counsel for the petitioner submits that the petitioner has shown his inability to attend the Court or for reconciliation.
Patna High Court Cr.Misc. No.3797 of 2017 (4) dt.03-03-2017 2/2 Considering the nature of allegation against the petitioner, I am not inclined to grant him anticipatory bail in connection with Bagaha Mahila Police Station Case No. 52 of 2016 pending in the Court of learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran.
Hence, prayer for bail is refused.
