The petitioner seeks regular bail in connection with Excise Case C2A No. 24 of 2021 instituted for the offences under Sections 30(a), 32(1)(2) and 41(1) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 24.01.2021, is a person with clean antecedent and charge-sheet has been submitted. Allegation is of recovery of 3483.360 litre of liquor from a truck as detailed in the FIR.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.31914 of 2021(4) dt.23-02-2022 2/2 petitioner is the driver, as such, he was not aware what was loaded by the owner and the transporter in the truck. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Excise Case C2A No. 24 of 2021.
