The petitioner seeks regular bail in connection with Kankarbagh PS case no. 894 of 2018 registered for the offence punishable under Sections 272, 273 of Indian penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 85 ltrs. of illicit liquor from an auto rickshaw which was being driven by the petitioner herein.
The learned counsel for the petitioner submits that the petitioner is not the owner of the said tempo, hence cannot be saddled with the liability of the recovered illicit liquor. It is further submitted that the illicit liquor might be belonging to the passenger. Lastly, it is submitted that the petitioner is having a
Patna High Court Cr.Misc. No.72433 of 2018(2) dt.13-12-2018 2/2 clean antecedent and is languishing in custody since 27.09.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge(Excise), Patna in connection with Kankarbagh PS case no. 894 of 2018.
