Informant, while he was on his way to Muzaffarpur from Sitamarhi, was intercepted near Pitaujhiya by the unknown criminals, who on the point of firearm, snatched away his motorcycle, laptop, mobile set, cash, ATM card etc. From the case diary, it is evident that petitioner was apprehended by Incharge, Punaura OP and further, as alleged made inculpatory extra judicial confessional statement whereupon motorcycle of present case was recovered from his possession and on the basis thereof has been remanded in this case, although charge-sheet had already been submitted but the reason best known to the prosecution, has not been put on TIP. Petitioner happens to be under custody since

Patna High Court Cr.Misc. No.46235 of 2016 (5) dt.11-01-2017 14.01.2016.

That being so, petitioner, Subodh Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Muzaffarpur in Hathauri PS Case No. 63/2016.
