This application for grant of regular bail arises out of Sadar Circle Excise Case No. 05 of 2020 arising out of Special Case No. 62 of 2020, registered for the offence punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
The petitioner's prayer for grant of regular bail was earlier rejected by this Court by an order dated 02.03.2020 passed in Cr. Misc. No. 10576 of 2020. Allegedly, from a Tata Tiago vehicle, 165.99 liters of Indian made foreign liquor was recovered by the Excise officials. The petitioner was apprehended, who was found sitting in the said vehicle. Patna High Court CR. MISC. No.25970 of 2020(2) dt.22-01-2021 2/2 allowed regular bail by this Court by an order dated 28.02.2020 passed in Cr. Misc. No. 11101 of 2020.
Considering the submission that similarly circumstanced co-accused has been allowed regular bail by this Court, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Araria, in Sadar Circle Excise Case No. 05 of 2020 arising out of Special Case No. 62 of 2020.
