The petitioner seeks bail in Durgawati P.S. case No. 22 of 2011 under Section 392 of the Indian Penal Code. It is submitted that petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. Although the petitioner was declared absconder but he had no knowledge of his involvement in this case. The petitioner was arrested on 02.07.2016 and since then he is in jail but he has not been put in T.I. parade. The petitioner has already remained in jail for about five months.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner
Patna High Court Cr.Misc. No.39766 of 2016 (3) dt.29-11-2016 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in Durgawati P.S. Case No. 22 of 2011, G.R. No. 327 of 2011.
