JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner came with lathi at the door of the informant and assaulted repeatedly with lathi to the son of the informant Mithlesh Ram. The victim was thereafter taken to the hospital for treatment but during treatment, he succumbed to the injuries.

Patna High Court CR. MISC. No.32524 of 2021(6) dt.13-02-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The postmortem report suggests that deceased Mithlesh Ram died due to shock and Hemorrhaged and the medical report does not corroborate the allegations levelled against the petitioner. The petitioner is languishing in custody since 07.08.2020. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

A report was called for vide order 16.01.2023 with regard to the present stage of the case. The report has been received and it has been kept at Flag-F. The report suggests that no prosecution witness has still been examined.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court CR. MISC. No.32524 of 2021(6) dt.13-02-2023 3/3 (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Siwan in connection with Andar P.S. Case No. 79 of 2020 (Sessions Trial No. 274/2020).
