The present application has been filed for modification of the order dated 28.08.2015 passed in Criminal Miscellaneous No.33541 of 2015 in connection with Sasaram (Bhabhua) Rail P.S. Case No.22 of 2015, to the extent that in the last paragraph, of the order inadvertently, "learned Chief Judicial Magistrate, Bhabhua" has been recorded in stead of "learned Chief Judicial Magistrate, Gaya". The said mistake perpetuated in the order since it was wrongly mentioned in the prayer portion of the main petition.

Hence, learned counsel for the petitioner is permitted to make necessary correction in the prayer portion of the main petition.

In view of the aforesaid, let in the last paragraph of the order dated 28.08.2015 "learned Chief Judicial Magistrate, Bhabhua" be read as "learned Chief Judicial Magistrate, Gaya.

Patna High Court Cr.Misc. No.44106 of 2015 (2) dt.16-09-2015 2/2 The order dated 28.08.2015 stands modified to the extent as indicated above.

Accordingly, the modification application is disposed of.
