2. The petitioner seeks regular bail in a case registered for the offence punishable under sections Section 126 ( 2 ), 115 ( 2 ) , 303 ( 2 ), 109, 352, 351 ( 2 ), 3(5) of the Bharatiya Nyaya Sanhita 2023 and 27 of Arms Act.

3 . As per the prosecution case , these petitioner along with other co-accused persons abused and assaulted informant due to which he sustained head injuries.

4. Learned counsel appearing for the petitioner submitted that specific accusation of assault on the head of informant with butt of pistol is against other co-accused person . So far as this petitioner is concerned, allegation is general and

Patna High Court CR. MISC. No.21914 of 2025(2) dt.25-04-2025 2/2 omnibus against him. Doctor has found the injury simple in nature . Charge sheet has already been submitted. Petitioner is in custody since 20.01.2025 .

5 . Learned counsel for the State opposed the prayer for bail.

6. Considering the aforesaid facts of the case , period of custody and other circumstances of the case , prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM Vaishali at Hajipur in connection with session Jandaha P. S. Case No. 278 of 2024 .
