The petitioner is in custody in connection with Aurangabad Town P.S. Case No. 98 of 2020, for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 02.03.2020. He further submits that in the instant case total 240 litres of country made liquor was seized from Sumo Victa. He submits that the petitioner is neither owner of the vehicle nor anything was recovered from his conscious possession. Considering the fact that the petitioner has no criminal
