JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 364/120B, 302, 201, 379/34 of the Indian Penal Code.

Petitioner is named in the FIR with allegation that he also participated in kidnapping and murder of the deceased of the present case. The learned trial court has reported that only eight prosecution witnesses have been left to be examined. The learned trial court has sought six months time for disposal of trial of the petitioner.

Regard being had to the facts and circumstances as well as submissions of the parties, I am not inclined to release

Patna High Court CR. MISC. No.1189 of 2019(6) dt.21-05-2019 2/2 the petitioner on bail and, accordingly, his prayer for bail in connection with Kashim Bazar P. S. Case No. 150 of 2014 stands rejected.

However, the petitioner may renew his prayer for bail, if his trial is not concluded within the above stated period of six months.
