Petitioner seeks regular bail in connection with Town P.S. Case No. 313 of 2020 registered for the offence under Section 401 , 379 , 413 and 414 of the I.P.C. A bike was intercepted by the Police on which the petitioner was a pillion rider and it was found to be a stolen property.
Learned counsel for the petitioner submits that petitioner is a student studying in R.K. College in B.A. Part-I and on the date of occurrence he took lift from the person who was driving the bike and was intercepted and apprehended by the Police. Learned counsel next submits that the person, who was driving the vehicle disclosed the name of one Deepak
Patna High Court CR. MISC. No.32525 of 2021(2) dt.20-12-2021 2/2 Kumar Yadav, who had allegedly stolen the said bike and the Deepak Kumar Yadav has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 42209 of 2021. He next submits that petitioner is in custody since 21/12/2020 having no criminal antecedent and charge sheet has already been submitted.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent , he is in custody since 21-12-2020 and the co-accused / Deepak Kumar Yadav has been granted bail by a Co-ordinate Bench of this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Town P.S.
