JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2017 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Sasaram Nagar (Muffasil) P.S. Case No. 843 of 2016 for the offences instituted under Sections 379, 341, 504 and 506/34 of the Indian Penal Code.

The allegation against the petitioner no.1 is of outraging the modesty of the informant and the allegation against the petitioner no.2 is of taking brief case of the cousin of the informant, in which, cash and ornaments were kept. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

The petitioners have falsely been implicated in the present case. The petitioner no.1 happens to be the Devar of the complainant/informant and the petitioner no.2 is the father-in-law of the petitioner no.1. Annexure-2 is the case filed by the petitioners against the complainant. The date of occurrence is 05.05.2015 but the Complaint case was filed on 11.05.2015. Delay has not been explained by the prosecution. On behalf of the State, it has been submitted that the petitioners are named in the Complaint/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Sasaram Nagar (Muffasil) P.S. Case No. 843 of 2016 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
