In this case, the petitioner is seeking regular bail in connection with Sadar P.S. Case No. 208 of 2020 registered for offence punishable under sections 341, 326, 323, 353/34 of the Indian Penal Code and sections 30 (a)/45 of the Bihar Prohibition and Excise Act.
It has been alleged that 37 litres of illegal liquor has been recovered and the petitioner is in custody since 30.04.2020.
Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each
Patna High Court CR. MISC. No.21988 of 2020(3) dt.06-01-2021 2/2 to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Sadar P.S. Case No. 208 of 2020, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in future in the same type of offence, the prosecution will have liberty to file an application for cancellation of his bail bond and the court below will pass an order in accordance with law.
