Learned counsel for the petitioner has submitted that the case has been maliciously instituted in order to give undue pressure on the petitioner with respect to civil dispute between the petitioner and the informant.
It is not known as to whether the police have completed investigation or not, though the First Information Report was instituted in the year 2013.
Considering the submission advanced on behalf of the petitioner that pendency of a false police case itself amounts to undue harassment to the petitioner, I direct the Sr. Superintendent of Police, Patna to ensure that the investigation is completed
Patna High Court Cr.Misc. No.43556 of 2013 (2) dt.30-03-2016 preferably within a period of three months from the date of receipt/ production of a copy of this order.
The petitioner shall have liberty to raise the plea, as has been raised in the present application, at the stage of investigation, taking of cognizance, framing of charge or at any subsequent stage, as may be permissible to him under law.
