Heard Mr. Yugal Kishore, learned counsel for the petitioner and Mr. Md. Aslam Ansari, learned counsel for the State.

The petitioners seeks bail in connection with Sadar P.S. Case No. 208 of 2020 dated 16.04.2020 instituted for the offences under Sections 341, 323, 326, 353/34 of the Indian Penal Code.

It appears from the First Information Report that the petitioners along with others were arrested and from their possession 37.215 litres of liquor was recovered. Learned counsel for the petitioners submits that the petitioners have been arrested on mistaken identity and allegation of assaulting the police party is super addition in order to lend serious colour to the case. Petitioners have clean antecedents and they are in custody since 17.04.2020. Regard being had to the nature of accusation, quantum of recovery and the period of custody of the petitioners, they are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) each with two sureties of like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Sadar P.S. Case No. 208 of 2020.
