JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2015 The petitioner is apprehending his arrest in connection with Minapur P.S.Case No.449/2014 instituted under Sections 406 and 420 of the Indian Penal Code.
Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that after enquiry as per direction of District Agriculture Officer, vide letter no. 2098, dated 8.11.2014 and Joint Director, Tirhut Division vide letter no. 2062,dated 8.11.2014 with allegation that the petitioner being Block Agriculture Officer, Minapur by ignoring the direction of government in implementing Kharif Scheme, 2014 Sri Vidhi Paddy demonstration and misappropriated the government money. It has been submitted on behalf of the petitioner that there is no specific allegation in the FIR in respect to
Patna High Court Cr.Misc. No.52182 of 2014 (3) dt.07-05-2015 2/2 misappropriation of the amount nor there is any specific allegation in respect to mis-conduct carried out on his part. On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Muzaffarpur in connection with Minapur P.S.Case No. 449 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C. It is further directed that the petitioner shall deposit an amount of Rs.25,000/- in the court below, which will be subject matter of the result of the case.
