The petitioner has retired on attaining the age of superannuation on 31.10.2019. He was working as Marketing Officer in the office of Deputy Director, Food, Patna Division. Counsel appearing on behalf of the petitioner would submit that the petitioner has not been paid GPF amount, GIS, Unutilized Leave Salary, Gratuity and Pension. He was also not granted benefit of 2nd and 3rd ACP. Counsel submits that in terms of the notification No. 1609 dated 29.05.2011 issued by the

Patna High Court CWJC No.6239 of 2020(2) dt.26-06-2020 2/2 General Administration Department, Government of Bihar, Patna, the petitioner was entitled to exemption from passing computer examination and for which the petitioner had approached the respondents and favourable recommendation was made by the respondents.

Considering the fact that the petitioner has superannuated on 31.10.2019, the respondents are directed to grant the benefit of 2nd and 3rd ACPs under the ACP Rules and ensure payment of the entire post retiral dues, if not already paid, within a maximum period of four months from the date of receipt/production of a copy of this order failing which the petitioner shall be entitled to 9% interest from the date of retirement till the date of actual payment.

With the aforesaid, the writ petition stands disposed of.
