The petitioners apprehend their arrest in registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Prosecution case in brief is that on the alleged date and time of occurrence while the informant was constructing his house, all the accused persons including petitioners variously armed came and assaulted informant and his wife. Petitioner no. 1 gave Tangi blow on the head of injury causing injury. It is submitted that both parties are Gotia and there is

Patna High Court CR. MISC. No.23767 of 2022(2) dt.08-09-2022 2/2 land dispute between the parties. The alleged occurrence took place over the construction of wall. There is case and counter case. Injuries sustained by the informant are simple in nature. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 405 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
