JUSTICE VIKASH JAIN ORAL ORDER 29-06-2020 Heard learned counsel for the petitioner and learned APP for the State through video conference. Learned counsel for the petitioner undertakes that all defects pointed out by the Stamp Reporter shall be removed, and compliance with the conditions of the notices of this Court with regard to acceptance of e-filing shall be made, without delay immediately after the lockdown ends, and in any event within one month thereof.
2. The petitioner is in custody since 28.01.2020 in connection with Birpur P.S. Case No. 202 of 2019 for the alleged offences under Sections 420, 409 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated in connection with fraud and forgery committed as two persons of the same name and address were working at two different places in the Water Resources Department, thus causing loss to the Department It is submitted that the enquiry report of the three man Committee on which the FIR is based has been passed exparte. It is submitted that the petitioner has already suffered about six months in custody.
4. Learned APP appears and invites reference to the
Patna High Court CR. MISC. No.20959 of 2020(2) dt.29-06-2020 2/2 impugned order in which it has been noticed that Sri Suresh Ram having ID No. 4559 working as Assistant Engineer, Bhim Nagar under transfer to Amba, Aurangabad and Sri Suresh Ram ID No. 8981 posted as Assistant Engineer in the Building Department are the same person, having same parentage, PAN number, date of birth, home district, details of property declaration given to the Government as well as names in the "pariwarik suchi'. The petitioner has prior antecedent in Kishanganj P.S. Case No. 395 of 2019 instituted under Section 419, 420, 467, 468, 471 and 120B of the Indian Penal Code.
5. Having regard to the nature of accusations and gravity of offence alleged, this Court is not inclined to grant the privilege of bail to the petitioner. The petition stands dismissed. However, the petitioner shall be at liberty to renew his prayer after completing one year in custody.
6. Office shall ensure that all defects have been removed and compliance with the notices of this Court has been made, within the stipulated time as provided in para 1 hereinabove. (Vikash Jain, J) Chandran/- U
