For the Petitioner/s : Mr. Sanjay Kumar For the Opposite Party/s Mr. Manoj Kumar - 1 ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12.04.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Earlier prayer for bail of the petitioner was rejected by this court taking note of the allegation as well as criminal antecedent but submission on behalf of the petitioner is that the petitioner is in jail custody since 30.11.2015 but up till now, his trial could not be concluded. It is further submitted on behalf of the petitioner that charge against the petitioner was framed on 3.9.2016 and except the informant, not a single prosecution witness has been examined. Since the petitioner happens to be the main assailant, I do not feel it proper to release him on bail, at least, at this stage and, accordingly his prayer for bail in connection with Session trial no. 240/2016 arising out of Parbatta P.S. Case no. 324/2015 pending in the court of Assistant Sessions Judge II, Khagaria is, again, rejected. However, learned trial court is directed to expedite the trial
Patna High Court Cr.Misc.
