This is a petition for grant of anticipatory bail for offence under Sections 302 and 201/34 of the Indian Penal Code.
The main allegation is against the husband of the deceased of commission of assault etc. due to his extra marital relations. The marriage was solemnized ten years back. The petitioner is brother of the husband. There is general and omni bus allegation of commission of murder against the petitioner also.
Submission of the petitioner is that there is no eye witness of the occurrence and petitioner has no criminal antecedent.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender,
Patna High Court Cr.Misc. No.22045 of 2017 (2) dt.18-05-2017 2/2 within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Parbatta (Mraiya) P.S. Case No. 14 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, I, Khagaria, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
