The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 447, 379, 354, 504, 506 of the Indian Penal Code.
As per the prosecution case, on 13.01.2023 at about 10 PM, this petitioner came at the door of informant' house in an inebriated condition and started molesting informant and thereafter, fled away after snatching her chain and ear-rings. It is submitted on behalf of petitioner that both parties are neighbours and due to petty dispute, a false and concocted case has been lodged. Though, alleged occurrence took place on 13.01.2023, but F.I.R. has been lodged on 19.01.2023 and there is no plausible explanation of delay.
Patna High Court CR. MISC. No.23501 of 2023(2) dt.27-06-2023 2/2 However, learned counsel for the informant vehemently opposes the prayer for anticipatory bail. Considering the delay in lodging the F.I.R. as well as aforesaid facts & circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Jamhore P.S. Case No. 11 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
