JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-12-2021 Heard the learned Senior Counsel for the petitioners and the learned APP for the State. The petitioners seek regular bail in connection with G.O. Case No. 74/21, registered for the offence punishable under Sections 30(a) and 56(b) of the Bihar Excise and Prohibition Act. The allegation is regarding recovery of 111 liters of illicit liquor from a car in which the petitioners are stated to have taken lift for the purposes of going to the State of Jharkhand.
The learned Senior Counsel for the
Patna High Court CR. MISC. No.33673 of 2021(2) dt.13-12-2021 2/3 petitioners has submitted that the petitioners are innocent, they have been falsely implicated in the present case and they are having clean antecedent. The learned Senior Counsel for the petitioners has further submitted that the petitioners have been arrested on 18.2.2021 and remanded in the present case on 19.2.2021. The learned Senior Counsel for the petitioners has further submitted that the petitioners are not the owner of the vehicle in question.
Per contra, the learned APP for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned Senior Counsel for the petitioners and taking into account the materials available on record as also considering the fact that the petitioners have categorically stated in the present petition that they are not the owner of the vehicle in question, I deem it fit and proper to direct for release of the petitioners on regular bail.
Patna High Court CR. MISC. No.33673 of 2021(2) dt.13-12-2021 3/3 Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Session Judge II cum Special Judge Nawada in connection with G.O.Case No. 74/21.
