JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-07-2025 Heard learned counsel appearing on behalf of the petitioner, learned APP appearing on behalf of the State and learned counsel for Opposite Party No. 2.
2. The petitioner apprehends his arrest in a complaint case registered for the offence punishable under Sections 341, 323, 307, 498A, 504, 506 and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
3. As per prosecution case, marriage of complainant was solemnized with this petitioner on 16.04.2021. It is alleged that after marriage, this petitioner, along with other accused persons, harassed and tortured complainant/Opposite Party No. 2 due to non-fulfillment of demand of dowry.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is husband of complainant/Opposite Party No. 2 and has committed no offence. At no point of time this petitioner demanded dowry or harassed the complainant/Opposite Party No. 2. It is further submitted that petitioner has already been directed to pay maintenance of Rs. 5,000/- by the Court of learned Principal Judge, Family Court, Samastipur vide order dated 18.03.2025 passed in Matrimonial Case No. 172 of 2022. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State and learned counsel for the complainant/Opposite Party No. 2 have vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Samastipur in connection with Complaint Case No. 2467 of 2023, subject to
