JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 06-05-2016 The petitioner claims that her husband had worked as part time sweeper since 1985 in Dhawani Branch, Punjab National Bank of district Rohtas. She claims that his service was confirmed on 01.05.2010. However, she further claims that all the death-cum-retiral benefits should be given to the petitioner considering his past services also, the stand of the petitioner is that confirmation of service was not considered for payment of all the death-cumretiral dues or pension. Learned counsel for the Bank submits that the service of the petitioner was confirmed on 01.05.2010 and thereafter he died on 30.07.2014. Therefore, considering only four years of service, all the benefits could not be granted.
Be that as it may be there is no such decision which has been brought on record by the petitioner refusing the petitioner's claim and as such
Patna High Court CWJC No.15845 of 2015 dt.06-05-2016 2/2 this Court would be inclined to dispose of this writ application by granting liberty to the petitioner to approach respondent no. 2 i.e. The Zonal Manager, Punjab National Bank, Patna Zone, Patna by filing representation giving all the details along with a copy of this order and on such representation having been filed, let a decision be taken by respondent no. 2 on its own merit and in accordance with law within a period of three months from the date of filing of such representation. If the petitioner's claim finds favour, then immediate steps should be taken for payment of retiral dues to her husband. However, if the petitioner's claim does not find any favour, then a reasoned order would be required to be passed and communicated to the petitioner. Accordingly, this writ application is disposed of with aforesaid direction.
