This application is for grant of bail in connection with Dumariyaghat P.S.Case No.74 of 2016 for the offence under Sections 304(B), 328,34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the petitioner is the husband of the informant and the case is under Section304(B) of the Indian Penal Code, however, during the pendency of this case, the informant has been examined in the sessions and she has not supported the prosecution case. Heard learned A.P.P. also.
Having heard both sides. In view of the submission of the learned counsel for the petitioner, aforesaid facts, I am not inclined to grant bail to the petitioner at this stage, however, the
Patna High Court Cr.Misc. No.298 of 2017 (3) dt.17-02-2017 2/2 learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer before the court concerned itself and the learned court below will consider the aforesaid facts as well as materials available on the record and will pass appropriate order without being prejudiced by the order of this Court.
With the aforesaid observation, this application is disposed of.
