JUSTICE ARUN KUMAR ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 272, 273 of the Indian Penal Code and 47 A, 53 C, 54 of the Bihar Excise Amendment Act, 1915.
Allegation in brief is that police received secret information that petitioner's father used to brew country made liquor and in total four litres of brewed liquor recovered from his house.
It is submitted that the allegation is against the father of the petitioner. Petitioner had no knowledge about conscious possession of illicit liquor kept in the house by his father moreover no equipment for brewing was recovered and this petitioner has
Patna High Court Cr.Misc. No.53695 of 2016 (2) dt.14-12-2016 2/2 been in custody for approximately four months and has got no criminal antecedent.
Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Rajepur P.S. Case No.117 of 2016.
