This application for anticipatory bail arises out of Runnisaidpur P.S. Case No. 493 of 2018, disclosing offences under Section 414 of the Indian Penal Code.
Two persons were arrested with a looted motorcycle. They are said to have disclosed the petitioner's name as the person who led the gang of motorcycle looters. Learned counsel, appearing on behalf of the petitioner submits that confessional statement of the accused persons is the only material against this petitioner, who has no criminal antecedent. He also contends that on the information given by the said co-accused persons, petitioner's house was raided but nothing has been found.
Patna High Court Cr.Misc. No.73169 of 2018(2) dt.19-12-2018 2/2 Considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S. Case No. 493 of 2018-, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
