JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.
The petitioner apprehends his arrest in connection with Maner P.S. Case No. 442 of 2015, registered for the offences punishable under Sections 364, 302, 201 of the Indian Penal Code. Allegedly, the brother of the informant was missing when he had gone to market to purchase some articles and thereafter his dead body was found. The deceased has some dispute with the petitioner and others and, as such, the petitioner and other might have killed the deceased.
Submission is of false implication and that coaccused Baiju Rai has already been allowed pre-arrest bail vide Cr. Misc. No. 33005 of 2016 by another co-ordinate Bench of this
Patna High Court Cr.Misc. No.5970 of 2017 (2) dt.22-02-2017 2/2 Court. Besides suspicion there is nothing against the petitioner and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that Baiju Rai has been allowed pre-arrest bail.
In the facts and circumstances as stated above, considering that only material is suspicion and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, learned J.M. 1st Class, Danapur, Patna, in connection with Maner P.S. Case No. 442 of 2015, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
