JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Balia P.S. Case No. 38 of 2018, registered for offences punishable under Sections 30(a) 32, 41(i) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery foreign liquor from the possession of other co-accused person and he has disclosed that the said liquor is of the petitioner. Further it appears that the petitioner is accused in four other cases, but not of the similar type.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession. Though, he is accused in four other cases, but he is on bail in those cases and he is in judicial custody since 03.09.2018 in this case.

Patna High Court Cr.Misc. No.74883 of 2018(2) dt.21-12-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ II Cum Special Judge, Excise, Begusarai, in connection with Balia P.S. Case No. 38 of 2018.
