The petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No.175 of 2015 registered under Sections 147, 148, 149, 341, 379, 342, 448, 354, 354(A), 504, 509 and 307 of the Indian Penal Code besides Section 27 of the Arms Act, pending in the court of the Sessions Judge, Jehanabad. The accusation against the petitioner is that he shot fire at Balaji, the son of the informant, Bindu Devi, from the front causing firearm injury on his left chest.
Learned counsel appearing on behalf of the petitioners submits that there was no repetition of firing by the petitioner at
Patna High Court Cr.Misc. No.43511 of 2015 (2) dt.15-10-2015 2/2 Balaji, the son of the informant. The petitioner being Gotiya of the informant has falsely been implicated in this case. There is civil dispute in between the parties Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within six weeks from today and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
