JUSTICE JYOTI SARAN ORAL JUDGMENT Date: 22-05-2017 Heard Mr. Prashant Sinha, learned counsel for the petitioner and Mr. A.B.Sinha, learned GA-8, for the State. In the nature of the order which this Court purposes to pass it would not require to delve deep into the merits of the claim. Suffice it to say that the petitioner superannuated from the post of Block Cooperative Extension Officer with effect from 31.3.2003. It is after his superannuation that the Assured Career Progression Scheme came into force vide notification dated 25.6.2003 with effect from 9.8.1999. The benefit under the scheme has not reached the petitioner. The petitioner though claims to have represented for the benefit but the representation on record does not justify the stand.

Patna High Court CWJC No.18225 of 2010 dt.22-05-2017 Having heard learned counsel for the parties, in my opinion, in case the petitioner is entitled to the benefit under the Scheme then his case requires a consideration and for the purpose I deem it proper to dispose of the writ petition with the liberty to the petitioner to raise his grievance before respondent no.3, Registrar, Co-operative Societies, with the details and the Registrar, Co-operative Societies, either by himself or by any officer, as he may think competent to do so, would consider the grievance of the petitioner and dispose of the same in accordance with law within a period of three months from the date of filing of such representation.

The writ petition is disposed of with the directions aforementioned.
