JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 15-10-2015 Heard counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Khagaria P.S. Case No. 248 of 2011 registered under sections 420 and 379 IPC.

According to the prosecution case, the informant was assigned certain job by the petitioner on agreed payment. He discharged the work, but instead of a sum of Rs. 2,16,195.00 he was paid a sum of Rs. 1,59,375.00 with Rs. 56,819.00 remaining due to be paid. When the informant demanded he was manhandled and forced to sign a paper.

Counsel for the petitioner submits that actually the work was assigned on hours basis. The informant has not disclosed the number of hours of work executed/carried out by him. However,

Patna High Court Cr.Misc. No.44089 of 2015 (2) dt.15-10-2015 2/2 for grant of anticipatory bail, he is ready to pay/deposit a sum of Rs. 10,000/- without prejudice to his right and defence to be withdrawn by the informant subject to the result of this case. Considering the aforesaid submission, the petitioner above named, in the event of arrest/surrender within six weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction Chief Judicial Magistrate, Khagaria in Khagaria P.S. Case No. 248 of 2011 on condition that along with the bail bonds the petitioner shall furnish receipt showing payment of Rs. 10,000/- to the informant and/or deposit the amount in the Nazarat of the Civil Court to be withdrawn by the informant subject to the result of this case.

One of the bailors shall be his own/close family member. In the event of framing of charge, he shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
