The petitioners apprehend their arrest in Angarghat P.S. Case No. 56 of 2016 instituted for the offence under Section(s) 147, 148, 149, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.

There is specific allegation in the written report that petitioner No. 4 Manoj Singh caused injury on the head of the informant with Garasa and petitioner Nos. 2 and 3 namely Ram Sagar Singh and Pramod Singh assaulted the father of the

Patna High Court Cr.Misc. No.8241 of 2017 (2) dt.27-02-2017 2/3 informant on his head with garasa. It is further alleged that petitioner No. 1 Lalan Prasad Singh assaulted the brother of the informant with Garasa on his head.

It has been submitted on behalf of the petitioners that there is case and counter case. The petitioners' side also received injuries. The injury report of the petitioners' side has been annexed as Annexure-3 series.

The injuries sustained by the informant in the instant case and his family members have been annexed as Annexure-4 series. From perusal of the Annexure-4 series, it appears that all the three injured received two injuries on the head, caused by sharp cutting weapon. Although the injuries have been descried to be simple in nature but so far as description of the injuries is concerned, it appears that it has been caused with intention to kill as there is repetition of blow on the injured persons.

In such circumstance, this Court is not inclined to enlarge the petitioners on anticipatory bail. The prayer of the petitioners for anticipatory bail is rejected. The petitioners are directed to surrender before the Court below within a period of six weeks from today in connection with Angarghat P.S. Case No. 56 of 2016 and seek

Patna High Court Cr.Misc. No.8241 of 2017 (2) dt.27-02-2017 3/3 regular bail, which shall be considered and disposed off on its own merit without being prejudiced by the order of this Court. (Sanjay Priya, J) Shageer/- U T
