JUSTICE ANIL KUMAR SINHA ORAL ORDER 17-12-2021 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Mukeshwar Dayal, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Garhpura P.S. Case No. 65 of 2020 registered for the offences punishable under Sections 341, 342, 323, 504, 506, 307/34 of the Indian Penal Code 1860 and Section 27 of the Arms Act.

The allegation against the petitioner is that he allegedly fired upon the informant, as a result of which, he received injury on his left hand.

Patna High Court CR. MISC. No.32263 of 2021(2) dt.17-12-2021 2/3 Learned counsel for the petitioner submits that both the parties are co-sharer and there is previous land dispute between the parties. Learned counsel further submits that the injury caused to the informant is simple in nature as is evident from the impugned order. He next submits that the petitioner is in custody since 29.1.2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the injury caused to the informant is simple in nature, the petitioner is in custody since 29.1.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Garhpura P.S. Case No. 65 of 2020.
