Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Marhowra P.S. Case No. 66 of 2019, registered for the offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.
There is a dispute between the parties with regard to the title of the land which has been soled to the petitioner no.1. The petitioner no.2 is the husband of petitioner no.1.
Patna High Court CR. MISC. No.34530 of 2021(4) dt.10-05-2022 2/2 Learned counsel for the opposite party no.2 submits that the opposite party no.2 has been cheated by the petitioners but he is unable to say whether any Title Suit is pending or not.
Considering the fact that the dispute involved in this case is civil in nature, this anticipatory bail application is allowed.
Let the petitioners, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Marhowra P.S. Case No. 66 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, the Court below is directed to conclude the trial of this case with a period of one year from the date of receipt/production of a copy of this order.
