ANJANA MISHRA ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 22.09.2018 in connection with Deepnagar P.S. Case No.344 of 2018, registered for the offence under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession but recovered from a ditch where the petitioner was alleged to have been sitting.

Considering the aforementioned facts and circumstances and that the petitioner is willing to face trial and appear in the court as and when required, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.76066 of 2018(3) dt.13-02-2019 2/2 each to the satisfaction of the learned Additional District & Sessions Judge-VI-cum-Special Judge, (Excise), Nalanda at Biharsharif, in connection with Deepnagar P.S. Case No.344 of 2018.
