The petitioners seek bail in a case registered under Sections 341, 307, 120(B) of I.P.C. Later on Sections 304(B)/34 of the I.P.C. and 3⁄4 of Dowry Prohibition Act was added. Allegation is that the accused persons including the petitioners caused death of the deceased due to non-fulfilment of demand of dowry.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 26.11.2018 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged
Patna High Court CR. MISC. No.23180 of 2019(5) dt.01-07-2019 2/2 against the petitioners. The petitioner No.1 is father-in-law and petitioner No.2 is mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.
On behalf of the State, it is submitted that the petitioners are named in the complaint case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- cum-Sub Judge II (West), Muzaffarpur in connection with Karja (Muzaffarpur) P.S. case No.145 of 2017 (G.R. No.2014 of 2017) arising out of Trial No.2671 of 2017.
