2. This application has been filed for direction to the respondents not to disposes the petitioners from their house

Patna High Court CWJC No.7929 of 2023(2) dt.28-11-2023 2/2 situated over Khesra No. 917 under Khata No. 158 situated at Village Hardiya, P.S. & Anchal Bettiah, District- West Champaran and to quash the notice issued to the petitioners asking them to show cause after initiating a proceeding under Bihar Land Encroachment Act bearing Encroachment Case No. 03/2022-23.

3. In the opinion of this court, no case for interference is made out in this case.

4. If the petitioners want, they can file a title suit for declaration of their Right, Title and Interest and they can file an injunction application in the same title suit.

5. In view of the above, this application is disposed of.
