This application for grant of regular bail arises out of G.O. Case No.664/2020 giving rise to Simri P.S. Case No. 111 of 2020, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing on behalf of the petitioner has submitted that recovery of 494.055 liters of illicit liquor was made from the place. which belongs to the joint family of the petitioner, whereas only petitioner has been named in the First Information Report.
Be that as it may, since the petitioner has been named in the First Information Report and from the place occupied by him, may be jointly with his family members, recovery of huge quantity of illicit liquor has been made, I am not inclined to grant the petitioner privilege of regular bail for the present.

However, the petitioner shall be at liberty to renew his prayer for bail after nine months, if there is no progress in the trial.
The Investigating Officer may keep in mind the petitioner's plea that not only he, but all members of the joint family possess the place from where the seizure of illicit liquor was made.
