The present application has been filed for modification of the order dated 10.04.2018 passed in Cr.Misc.No.9851 of 2018, by which the petitioner was granted provisional anticipatory bail in connection with Deo P.S. case No.43/16, pending in the court of C.J.M., Aurangabad and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks. Vide order dated 10.04.2018 passed in Cr.Misc.No.9851 of 2018, a consented order was passed directing the petitioner to deposit a demand draft of an amount of Rs.5,00,000/- in the court below within a period of six weeks and remaining Rs.5,00,000/- in five equal instalments in the first week of each month. It has been further submitted by the learned counsel for

No.35912 of 2021(2) dt.31-03-2022 2/2 the petitioner that due to some unavoidable reasons the petitioner could not surrender in the court below and could not comply the order dated 10.04.2018 passed in Cr.Misc.No.9851 of 2018. It is prayed on behalf of the learned counsel for the petitioner that further six weeks time may be extended so that the petitioner could surrender and furnish bail bond in the court below and comply with the order dated 10.04.2018 passed in Cr.Misc.No.9851 of 2018 (to deposit a demand draft of an amount of Rs.5,00,000/- in the court below within a period of six weeks and thereafter remaining Rs.5,00,000/- in five equal instalments in the first week of each month).

Considering the submissions made on behalf of the learned counsel for the petitioner, the period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order dated 10.04.2018 passed in Cr.Misc.No.9851 of 2018 will be same. The order dated 10.04.2018 passed in Cr.Misc.No.9851 of 2018, is modified to the extent as indicated above. The modification application is, accordingly, disposed of. (Sudhir Singh, J) Narendra/- U T
