2. The petitioner seeks bail in connection with Rajapakar P.S. Case No. 349 of 2025 registered for the offence under Sections 309(4) of the BNS.

3. As per the prosecution case, unknown criminals are said to have committed loot of motorcycle and mobile phone on a petrol pump.

4. The petitioner is in custody since 11.01.2026 and he has two criminal antecedents also.

5. The name of the petitioner has come in the self inculpatory statement of one co-accused Sonu Kumar. The motorcycle used in the crime belong to the petitioner. Materials

Patna High Court CR. MISC. No.21935 of 2026(2) dt.08-04-2026 2/2 have come during investigation in support of the fact that the petitioners and others are members of a gang which is committing loot of motorcycles for the purpose of using them in liquor trade and other illegal activities.

6. Considering the quantum of recovery, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
